1. General Information

1.1 About Trueskin

Trueskin is an AI-powered skincare analysis platform that provides users with skin assessments, product recommendations, and skincare routine suggestions based on uploaded photos and provided information.

1.2 Eligibility & Account Requirements

To use Trueskin, users must create an account and agree to these Terms & Conditions. By signing up, users confirm that they are at least 16 years old. Trueskin includes a confirmation step before account creation to verify compliance with this requirement. If we become aware that a user is under 16, we reserve the right to terminate their account and delete their data.

1.3 Personal Use & Limitations of Liability

Trueskin is intended for personal, non-commercial use only. The AI-generated assessments and recommendations provided within the app are for informational purposes only and do not constitute medical advice. Users are responsible for their own decisions based on the provided insights, and Trueskin assumes no liability for any outcomes resulting from actions taken based on AI-generated information.

Trueskin makes no guarantees regarding the accuracy, reliability, or suitability of AI results. Users should consult a healthcare professional for medical concerns related to their skin.

1.4 Prohibited Uses

While Trueskin is a personal-use application, certain activities are strictly prohibited, including but not limited to:

• Uploading inappropriate, offensive, or illegal images.
• Attempting to scrape, extract, or distribute AI-generated results outside the app.
• Reselling or commercially exploiting Trueskin's AI analysis, recommendations, or any other app content.
• Engaging in any activity that disrupts the functionality or security of Trueskin.

Failure to comply with these terms may result in the suspension or termination of a user's account.

2. User Accounts & Responsibilities

2.1 Account Creation & Security

Users may create an account to access Trueskin's features. Multiple accounts are permitted. However, users are responsible for maintaining the security of their accounts. If a user believes their account has been compromised, they must contact trueskin@hybor.co with relevant information to verify ownership and request assistance.

2.2 User Responsibilities

Users are solely responsible for all activity under their account. This includes:

• Keeping login credentials secure and confidential.
• Ensuring that any uploaded content complies with these Terms.
• Not sharing, distributing, or modifying AI-generated results for unauthorized purposes.

Trueskin is not liable for any unauthorized account access resulting from the user's failure to safeguard their login credentials.

2.3 Account Suspension & Termination

Trueskin reserves the right to suspend or terminate accounts at its discretion if a user:

• Violates these Terms, including prohibited uses.
• Engages in fraudulent, abusive, or disruptive behavior.
• Attempts to exploit Trueskin's features in unauthorized ways.

For users on a paid subscription, account termination due to violations will not result in a refund.

3. Payments & Subscriptions

3.1 Subscription & Billing

Trueskin offers a single subscription-based payment plan, which provides access to premium features. All payments are processed exclusively via Apple Pay through RevenueCat. Users must have a valid payment method linked to their Apple account to subscribe.

3.2 Renewals & Cancellations

Subscriptions are auto-renewing by default, meaning users will be charged automatically at the end of each billing cycle unless they cancel. Users may cancel their subscription at any time through their Apple account settings. Upon cancellation, access to premium features continues until the end of the current billing period, after which the subscription will not renew.

3.3 Refund Policy

Trueskin operates a strict no-refund policy. Once a payment has been processed, users are not eligible for a refund, including for partial billing periods. If a user cancels their subscription, they will retain access to premium features until the end of their current billing cycle but will not receive a refund for unused time.

If an account is suspended or terminated due to a violation of these Terms, the user forfeits any remaining paid access, and no refunds will be provided.

3.4 Changes to Pricing & Services

Trueskin reserves the right to change its subscription pricing or modify the services included in the subscription. In the event of a price change, affected users will be notified via email prior to the change taking effect. Continued use of Trueskin after the new pricing takes effect constitutes acceptance of the updated pricing.

4. Intellectual Property & Usage Rights

4.1 Ownership of Trueskin Content

All elements of Trueskin, including the AI-generated results, branding, user interface, and proprietary technology, are the exclusive property of Trueskin. Users do not acquire any ownership rights in Trueskin's intellectual property by using the app.

4.2 User-Generated Content (Photos & Data)

Users retain ownership of the photos they upload to Trueskin. However, by using the app, users grant Trueskin a license to store, process, and display their images and AI-generated results within the app.

Trueskin may use uploaded photos and AI-generated results for marketing purposes unless a user opts out by contacting trueskin@hybor.co. Additionally, Trueskin reserves the right to use aggregated and anonymized data to improve AI models, enhance user experience, and refine skincare recommendations.

4.3 Usage Restrictions

AI-generated results and insights provided by Trueskin are for personal use only. Users are strictly prohibited from:

• Distributing, modifying, or commercially exploiting AI-generated results outside the app.
• Attempting to reverse-engineer Trueskin's AI models, extract proprietary data, or manipulate results.
• Using Trueskin's content, branding, or technology in any unauthorized manner.

Any violation of these restrictions may result in account suspension or termination.

5. Disclaimers & Limitation of Liability

5.1 AI Accuracy & Medical Disclaimer

Trueskin is not a medical service, and the AI-generated results and recommendations provided within the app are for informational purposes only. Trueskin does not diagnose, treat, cure, or prevent any medical conditions. Users should consult a qualified healthcare professional before making any decisions regarding their skin health, treatments, or products.

Trueskin makes no guarantees regarding the accuracy, reliability, or suitability of the AI-generated results. The information provided by the app is based on AI analysis and should not be considered a substitute for professional medical advice.

5.2 User Responsibility & Assumption of Risk

By using Trueskin, users acknowledge that they are fully responsible for how they interpret and use the insights provided. Any actions taken based on AI-generated information are done at the user's own risk.

Trueskin assumes no liability for:

• Skin reactions, adverse effects, or health issues resulting from following AI-generated recommendations.
• Incorrect, misleading, or incomplete AI assessments.
• Any personal or financial losses related to decisions based on Trueskin's recommendations.

5.3 App Availability & Service Interruptions

Trueskin does not guarantee that the app will be uninterrupted, error-free, or available at all times. The service may be updated, modified, or discontinued at any time without notice.

Trueskin is not responsible for any loss of access, technical failures, or issues resulting from maintenance, updates, or third-party disruptions.

5.4 Limitation of Liability

To the fullest extent permitted by law, Trueskin, its operators, and affiliates disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the app.

If any liability is found to exist despite this disclaimer, Trueskin's total liability will be limited to the amount the user has paid for the service, if any.

Users agree that by using Trueskin, they waive any and all claims against Trueskin related to the use or misuse of AI-generated recommendations.

6. Governing Law & Dispute Resolution

6.1 Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. By using Trueskin, users agree that any disputes or claims related to the app will be subject to the jurisdiction of the courts of England and Wales.

6.2 Dispute Resolution

Before taking any formal legal action, users agree to first contact trueskin@hybor.co to attempt to resolve any disputes informally. Trueskin will make a reasonable effort to address concerns within 30 days of receiving the complaint.

If a resolution cannot be reached through informal negotiation, any dispute, claim, or controversy shall be resolved through binding arbitration, rather than in court. Arbitration will be conducted in the United Kingdom under the rules of an established arbitration provider, and the decision shall be final and enforceable.

Users waive the right to a trial by jury and agree that any disputes shall be resolved individually.

6.3 Class Action Waiver

Users agree that any claims against Trueskin must be brought on an individual basis and not as part of a class action, collective action, or representative proceeding.

7. Final Provisions

7.1 Policy Updates & Changes

Trueskin reserves the right to update or modify these Terms & Conditions at any time. In the event of a significant change, users will be notified via email. Continued use of Trueskin after any updates to these Terms constitutes acceptance of the revised Terms.

7.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

7.3 No Waiver

Failure by Trueskin to enforce any provision of these Terms shall not be considered a waiver of rights. Trueskin reserves the right to enforce any term or condition at a later time, even if it has not been previously enforced.
